After a group of oil refiners sued the U.S. Environmental Protection Agency (EPA) for denying Renewable Fuel Standard (RFS) small refinery waiver requests, a U.S. District Court has sided with the refiners. The Renewable Fuels Association CEO Geoff Cooper calls the decision disappointing and says national decisions should be handled by the D.C. Circuit. One judge on the Fifth Circuit dissented the ruling, also saying they had “no business interfering in an issue of national significance.”

There were just six refineries appealing the Fifth Circuit Court in New Orleans who will continue to get exemptions until any final word is decided. Renewable energy groups around the country released a joint statement Monday that they will continue to diligently fight for a robust RFS and the illegal abuse of small refinery exemptions.
